Pixel Assets Creations PTY LTD trading as PropertyEnhance (“PropertyEnhance,” “we,” “our,” or “us”) is committed to protecting your privacy and ensuring absolute transparency in how we collect, use, and secure your personal information. This Privacy Policy explains our operations regarding data management when you utilize our AI property photo enhancement services, website, and related digital tools (the “Service”).

By accessing, registering for, or using the Service, you consent to the processing of your personal information in strict accordance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA).

1Personal Information We Collect

Under POPIA, “Personal Information” encompasses any data that identifies a living natural person or an existing juristic person (such as a registered company, trust, or close corporation). We collect the following categories of information:

1.1 Registration and Account Information

Full name, corporate email address, phone numbers, trading company name, business registration numbers, and payment verification details (processed securely via automated third-party payment gateways like Paystack).

1.2 Uploaded Media and Metadata

Images, blueprints, or videos you upload for AI enhancement (the "Content"), alongside embedded metadata (such as EXIF data, timestamp metrics, and implicit geolocation details).

1.3 AI Configuration Data

System preferences, chosen editing filters, rendering requests, and specific styling inputs selected to process your images.

1.4 Device and Technical Logins

IP addresses, browser configurations, device identifiers, operating system metrics, and clickstream interaction logs.

1.5 Tracking Cookies

Operational cookies deployed to sustain active user sessions, retain user interface preferences, and analyze anonymized website traffic flows.

2Purpose of Processing Personal Information

We process your personal information strictly for clear, legitimate business functions necessary to fulfill our service delivery and statutory obligations, including:

  • Provisioning, operating, maintaining, and maximizing the performance of our AI-powered property enhancement models.
  • Executing secure financial transactions, billing cycles, and account administration workflows.
  • Providing responsive technical support, troubleshooting, and managing customer care interactions.
  • Formulating security barriers to protect our platform against system fraud, data abuse, or unlawful cyber intrusions.
  • Distributing operational updates, security bulletins, or authorized marketing communications (where you have provided explicit opt-in consent).
  • Complying with South African regulatory frameworks, company reporting tasks, and tax obligations under the South African Revenue Service (SARS).
AI Model Training & Anonymization: To optimize our proprietary processing software, we may use strictly de-identified, aggregated, and anonymized data derived from processed assets. This data is fully scrubbed of identifying property markers, recognizable human features, and corporate branding. We will never train public AI models on your raw or identifiable client imagery.

3Cross-Border Data Transfers (POPIA Section 72)

To execute advanced computational edits—including our Virtual Twilight services—PropertyEnhance utilizes secure globally distributed cloud infrastructure and top-tier third-party AI interfaces (such as Nano Banana Pro and Google’s Gemini 3 Pro Image).

By uploading data to our platform, you explicitly acknowledge and consent that your personal and property information may be transferred to, stored on, and processed by servers located outside the borders of the Republic of South Africa. In compliance with Section 72 of POPIA, PropertyEnhance ensures that all international operators, sub-processors, and cloud vendors are bound by binding corporate rules or data processing agreements that guarantee an equivalent level of privacy protection, data security, and systemic integrity as mandated within South African law.

4Sharing and Disclosure of Information

We strictly prohibit the sale, rental, or commercial trade of your personal information to third-party brokers. Data sharing is strictly confined to the following contexts:

Authorized Operators (Service Providers)

Trusted infrastructure partners, cloud storage matrices, and certified payment engines (e.g., Paystack) who act on our behalf under rigorous data confidentiality mandates.

Statutory Compliance

Competent law enforcement bodies or state regulators, if required to do so by a valid legal subpoena, law, or to proactively defend the rights, property, and physical safety of PropertyEnhance, our users, or the public.

Corporate Reconstruction

In the occurrence of an active merger, corporate acquisition, asset sale, or joint venture, user datasets may be transferred as an essential business asset under continuing confidentiality protocols.

5Data Security & Storage Retention

  • System Safeguards: PropertyEnhance institutes robust administrative, physical, and technical safeguards designed to protect personal and corporate data from accidental loss, unauthorized destruction, alteration, or unlawful access. These protocols include encrypted data transfers (HTTPS) and firewalled storage clusters.
  • Retention Limits: We retain personal account records only for as long as your profile remains active, as needed to deliver our services, or as required under South African statutory record-keeping periods (e.g., keeping transaction records for 5 years under tax laws).
  • Data Deletion: Original uploaded photos and processed images are permanently scrubbed from our active production servers within 30 days post-finalized rendering, unless a prolonged storage tier is explicitly selected within your account dashboard.

6Your Legal Rights (POPIA Section 5)

As an authorized Data Subject (whether natural or juristic) within South Africa, you possess clear statutory rights regarding your personal information:

Right of Access

The right to request confirmation and a full record of what personal data we hold regarding your business profile.

Right to Rectification

The right to request the prompt correction, updating, or modification of inaccurate or misleading records.

Right to Erasure (Deletion)

The right to request that we delete personal data that we are no longer legally mandated or authorized to retain.

Right to Object

The right to object, on reasonable grounds, to the processing of your data, or to withdraw previously granted consent for direct marketing channels at any stage.
